| CROSS-BORDER COOPERATION - A TOOL FOR CAPITALIZING AND PROMOTING CULTURE AND HISTORICAL HERITAGE | Author : Angela POPOVICI | Abstract | Full Text | Abstract :The purpose of this article is to analyze cross-border cooperation as one of the
important multifunctional tools aimed at developing good neighborly relations with
states on the borders of the European Union, as well as supporting economic and social
development and promoting European values in partner countries in the context
of EU enlargement. The long-term objectives of cross-border cooperation projects
aim at: creating more bilateral benefits; improving the physical and economic infrastructure;
human resources development of the region; deepening cultural and educational
ties; preparing for EU membership; environmental protection etc. Cross-border
cooperation is favored by cultural heritage, ethno-linguistic heritage, historical
heritage or the presence of national minorities. The Romanian community in Ukraine
or the Ukrainian community in Romania, the common ethno-linguistic heritage of
the population of Romania and the Republic of Moldova are favorable elements in
the process of cross-border cooperation. |

in the strengthening of democracy and the rule of law, their dialogue with the public
authorities being a precondition for this. By analyzing the development of dialogue
between Moldovan CSOs and Central and Local Public authorities (CPA / LPA), I found
that PA are not yet fully aware of the value of the dialogue, which is sporadic and guided by certain interests, that do not always coincide with the public interest.
The key objective pursued by this research was to review the environment underlying
activity and collaboration of the civil society from the standpoint of influence exerted
by the internal and external factors that determine the core essence of the social environment, while paving and setting conditions for carrying out activities and collaboration between the civil society and public authorities. The paper aims to prove that more
communication and collaboration between public authorities and civil society organizations, will likely result in a more inclusive, qualitative and focused act of governance.
The author analyses and presents the existing decision-making systems and its consultation mechanisms with the civil society organizations in the Republic of Moldova, the
existing opportunities for CSO’s involvement in the public policy making process and
the actual practices.A number of research methods were used in the study, aimed at highlighting the
particularities of the dialogue and cooperation between the public authorities (PA) and
the CSOs, as part of the act of governance, studying the development over time and the
influence of various social, economic and political factors on these processes. Thus, the
historical analysis method to research the origin and evolution of the legal framework
that regulates the dialogue and cooperation between PA and the CSOs was applied. It
included analysis of the relevant laws, regulations and policies, together with existing
reports and studies on the subject of research, in the Republic of Moldova. I found that
public authorities are not yet fully aware of the value of the dialogue and the political
factor is also of great influence, as in recent years there has been an increasing pressure
on the civil society. The paper reflects the current situation in Moldova, which can be
summarized as follows: a) there are no permanent mechanisms or platforms for cooperation and consultation, open to all. Civil society participation is limited to a small
number of CSOs, and there are no incentives for the growth of CSOs. b) LPAs, compared
to CPAs, enjoy a much higher level of ,,trust” from the society/community, but they rarely have the resources and skills to conduct a constructive dialogue with CSOs; c) there
is a proven reluctance of the LPA/CPA to deepen the dialogue and cooperation with the
civil society; d) The culture of participation is very weak as there is no perception that
participation is an instrument of change. A number of recommendations in order to
address the identified problems are listed. |

| REPUBLIC OF MOLDOVA - EUROPEAN ASPIRATIONS AND IMPROVEMENTS TO INTEGRATION | Author : Dana PAIU | Abstract | Full Text | Abstract :After the signing of the Association Agreement between the Republic of Moldova
and the European Union on June 27, 2014, it was obvious that the European option
becomes a priority for the future of the Republic of Moldova. Although the political
forces present in the arena of Moldova were divided into two almost equal segments:
some opted for European Integration, others opted for the Eurasian Union.
In this context, the European aspirations of the Republic of Moldova were clearly
outlined and, in the same way, the main impediments to EU integration were formulated. The contradictions between the two options were like litmus paper that
marked the differences and possible obstacles to integration. The task of the politicians was to make the road outlined in the Association Agreement as fast as possible,
with tangible results and the achievement of the goals outlined in the Agreement.
But it was not to be, the road traveled was much more difficult, with multiple errors,
hesitations and political failures due to which the Republic of Moldova is still at a
crossroads of history. |
| DEVELOPING INSTRUMENTS FOR THE RECOVERY OF CRIMINAL ASSETS | Author : Alesea SCORPAN | Abstract | Full Text | Abstract :There is a global trend towards the widespread application of confiscation of criminal assets, especially those obtained as a result of corruption offenses. Given that
criminals are becoming increasingly intelligent and already know the tools used by
law enforcement agencies, it is becoming increasingly difficult to fight crime.
Through this article we set out to research new methods used by other states or
proposed by some authors in the field of recovery of criminal assets. We all know
the tools such as confiscation, requests for international legal assistance, seizure, but
these are the tools that float above the water, long visible and known not only by law
enforcement agencies but also by criminals. What is of real interest are the instruments that are at the ,,bottom of the sea” where not every state had the courage to
sink, but they found a real treasure, materialized in recovered criminal property.
Some tools are taken from the practice of British law, others are just ideas from
practitioners who have worked in the field of criminal property recovery.
Confiscation of property is an important tool in the fight against crime, we do not
deny the importance of official instruments, but we consider it appropriate to widen
the limits imposed by national legislation in this field. |

on the other hand, is one that can make a significant contribution to setting clear
guidelines for environmental protection through appropriate regulations and public procurement policies that would give environmental standards a leading place. In the article below we emphasize that the regulation of environmental criteria
in public procurement law is only a necessary condition, but by no means sufficient. There is a whole set of prerequisites that should be met for effective regulations

The analysis of the configuration of the management of international publicprivate partnership projects, in the conditions of financial and economic instability, highlights the issue of attracting the private sector to participate in the management and financing of socially significant strategic infrastructure projects. regard, this article is intended to extrapolate the project management methodology in the context of public-private partnership, the implementation of which can
significantly improve the process of managing public-private partnership projects. |

According to the
authors, national food security is the ability of the national food system to satisfy the
scientifically based physiological needs for food of all social groups of the population
as much as possible through its own production, provided that these groups are equal
in consumption of a minimum sufficient in quantitative terms and a balanced assortment of food products that meets the accepted nutritional and quality standards.
It is concluded that the Republic of Moldova, unlike the existing practice, should
approach food security in line with generally accepted scientific and practical approaches: ensuring physical and economic access to quality food for all groups and categories of the population. |
