At the European level the most important preoccupations referring to penal responsibility of the companies are found in the European Council and European Union. Due to this the Minister Committee of the European Council in time has approved a long series of recommendations and resolutions that refer to the penal responsibility of the companies.

In the studies of criminology, psychology and sociology studied, I noticed in some authors the attempt to reveal in the criminal the social mutant, the odious deviation from the human pattern, the criminal genetic programming. Other authors have found minimal, conjuctual differences between criminal and non-criminal. A "something" coming from outside has created the difference between two normal people, pushing crime, and thus designating one of them the pariah of society and nothing can prove that it would not have happened to the other. The fascination exercised by this dilemma of the criminal personality was determined in choosing the theme of the work, drawing up my work, discovering bold questions and a multitude of answers on the causality of the crime, an exciting show of ideas and theories from which I tried to reproduce here a part. The term personality is used to describe the temperament and emotional attributes of an individual, which basically determines their behavior. It is vital to approach psychology in an attempt to capture and understand a person s behavior, especially when it comes to estimating his future actions.

The need to criminalize criminal participation results from the high social danger posed by several criminals committed by the criminal law, as this is the main reason for choosing this topic. Related criminal offenses, material and intellectual contributions of offenders considerably increase the danger to society and criminal law can not ignore this reality in the field of crime. There are offenses that may be committed by one person, but most of these crimes are committed by more than one person, the explanation of this cooperation for committing a crime is that it creates the possibility of safer execution, it is ensured removing obstacles more easily and there are more chances of success.

Daniele Lochak argued that „the history of human rights are the history of a struggle”, the struggle for respect for human dignity by state authorities. Thus, in order to make human rights defense more efficient, in time, the principle of the absolute sovereignty of the states was limited, these agreeing on international instruments, the creation of international protection systems to ensure to their citizens a second level of rights protection. The scientific work carried out briefly exposes the problem of the legal relations, born between the state and the individual, having as object the nationalization of the buildings abusively during the communist Romania period. In the content of the work I wanted to highlight in the five sections the considerations of the European Court of Human Rights, an international court that ensures the second step of defending human rights, regarding the famous Brumarescu case against Romania, and also to bring a personal report to the case for the trial and a draft „law ferenda” – (with a view to the future law).

In order to identify the degree of satisfaction of the employers regarding the professional training and practice of the masters graduates in administrative sciences, the main deficiencies manifested by the employees, which should be corrected in the academic environment and the degree of adaptation of the educational requirements from the postgraduate environment to the real needs of the labor market, we applied a questionnaire on a number of 245 persons working in public institutions in Constanta county. We assume that the degree of satisfaction of the employers regarding the professional and academic training of the graduates is a satisfactory one, and the difficult principles of the employees being: communication skills and the insufficient specialized practice.

This prompted a change in the whole structure of economic, social and political development of the country. The problem of Romanian Public Administration is considered to be one of the arrears overall reform process, the goal of EU accession offered Romania the general framework in which reforms could be achieved. It is recognized that the process of modernization and reform that took place in Romania in recent years has been rather slow. Some areas have progressed faster than other areas. The reform process has had some priorities, including public administration. Unfortunately, modernization and reform in this sector has not enjoyed a sustained dynamism so that the European Commission had to draw constant attention to Romania to speed up the reform process in public administration.
