Author : Aneeda Jan |
Abstract | Full Text |
Abstract :It is well settled that an unreason able delay in the administration of justice constitutes an unconscionable denial of justice. Prolonged trial and delay in justice infringes right to life. Delay in the trial of criminal cases affects not only the accused, victim but society as a whole. Delay in the trial of criminal cases might involve destruction of liberty and annoyance to the occupation of the accused and puts him to undue harassment. On the other hand it results in the failure of criminal justice system to control the retributive tendencies and generally leads to dismay and delusion of the victim and encourages him and the society to take law in to his own hands and thereby recourse to unlawful means to settle scores with the perpetrators of the crime themselves. If the problem of delay and arrears, and pendency in criminal process is not properly addressed the people would lose faith in the ability of process to dispense justice endangering the very existence of the system.

CONGRESS PARTY AND INDIAN DEMOCRACY |
Author : Baburaya. C. Sagar , Sharanappa. H. Katti |
Abstract | Full Text |
Abstract :In these last several weeks that have followed the election victories of the Bharatiya Janata Party in Gujarat and Himachal Pradesh, the party is suffused with a new political energy. It is buoyed by the victory of its controversial icon iNarendra Modi in Gujarat and is wasting no time in converting these successes into crucial political capital before the Lok Sabha elections scheduled for next year. The Congress party, on the other hand, is shoving distinct signs of disorientation as a result of this political outcome, with a sense of listlessness clearly discernible in its approach. Such a fainthearted response is unwarranted and unbecoming of a party that seized the I high ground in the 2004 general election and exuberantly took up the reins of governance with the promise of bringing India back to its original moorings in secular democracy.
