ACIDENTES DE TRÂNSITO DECORRENTES DE EMBRIAGUEZ AO VOLANTE: CULPA CONSCIENTE OU DOLO EVENTUAL? | Author : Alexandre Jacob, Carolayne Santos Monte | Abstract | Full Text | Abstract :Confronted with the delicate distinction between eventual intent and conscious guilt, the overarching objective of this study is to discern the stance adopted by the Brazilian judiciary in cases involving traffic accidents caused by drivers under the influence of alcohol. The inquiry seeks to determine whether the prevailing view within the judiciary posits that the perpetrators actions are invariably driven by eventual intent, or alternatively, if there exists a possibility of the individual acting with conscious guilt. This research delves into the realm of Criminal Law, employing methodologies such as literature review, legislative analysis, and examination of jurisprudential trends. The study elucidates the conceptual framework of penal institutes and delineates the practical distinctions between eventual intent and conscious guilt. It sheds light on the criteria embraced by the judiciary for the effective prosecution of the criminal offense. The findings of this investigation suggest that, despite the established criteria, there remains a pressing need for clarifying legislation to enhance legal certainty for legal practitioners, mitigating the potential for miscarriages of justice.

| ANÁLISE DA RESISTENCIA A COMPRESSÃO DO CONCRETO PELA INCORPORAÇÃO DE DETERGENTE SINTÉTICO COMO ADITIVO PLASTIFICANTE | Author : Thobias Ribeiro Pessoa, Endrik Nardotto Rios | Abstract | Full Text | Abstract :This study aimed to assess the strength of 30 concrete specimens produced with Portland cement, incorporating various concentrations of detergent. The experiment comprised six reference specimens using standard Portland cement and anadditional six specimens with the inclusion of plasticizer additives. The consistent trait was maintained across all six studied concentrations. The reference Portland cement specimens were prepared without the addition of any additives. Specimens labeledas dosages 01 to 05 received synthetic detergent in varying amounts, while the final dosage incorporated a plasticizer additive. Slump tests were conducted on all specimens to evaluate the concrete workability. The molding and curing procedures followedthe standards outlined in NRB NM 67(1997) and NBR 5738 (2013) for concrete, respectively. These procedures were executed using equipment from the civil construction laboratory at Unesc-Polo Colatina. Following the molding process, the specimens were submerged in water tanks until they underwent a 28-day curing period. Subsequently, they were subjected to a breaking test utilizing an automated press of the EMIC brand, model: PC200c. Analysis of the resistance results revealed that dosages 1 to 5 exhibited lower strengths, ranging from 10.79 MPa to 5, in comparison to the reference concrete dosage with a strength of 21.44 MPa. Notably, the plasticity of these dosages (1 to 5) was found to be directly proportional to the amount of detergent applied to the concrete. |
| EFEITOS DA COVID-19 NA GESTAÇÃO E INFLUÊNCIA DA GESTAÇÃO NA DOENÇA | Author : Thayla Thompson Côrtes, Sofia Boechat Melado, Emelyn Alves Linause, Vitória Rocha Souza, Fábio Ramos de Souza Carvalho, Linda Christian Carrijo-Carvalho | Abstract | Full Text | Abstract :COVID-19 has been recognized as a systemic illness caused by the novel coronavirus, prompting concerns regarding its implications for the health of pregnant women and their fetuses. Understanding the potential effects of the virus on pregnancy and how alterations in pregnant women physiology may impact the course of the disease is crucial for guiding appropriate interventions in suspected cases. This article reviews literature data to identify potential perinatal and obstetric complications arising from SARS-CoV-2 infection, explores vertical transmission, and assesses the influence of pregnancy on the clinical progression of COVID-19.Pregnant women under go anatomical and physiological changes, such as diaphragm elevation and immunosuppression, rendering them more susceptible to infections. Conversely, immunosuppression could be viewed as a mitigating factor to reduce the severity of the multisystem inflammatory syndrome associated with the "cytokine storm." Conditions like obesity, cardiovascular disease, and diabetes elevate the risk of severe illness in pregnant women. Prematurity emerges as a prominent consequence for newborns. Evidence suggests the potential for vertical transmission and passive immunization of the fetus. In the context of protecting both mother and fetus, immunization of pregnant women with currently available vaccines appears to be a primary preventive measure. This comprehensive review aims to contribute to the understanding of the intricate dynamics between SARS-CoV-2 infection and pregnancy, providing valuable insights for informed clinical management and public health strategies.

| RESPONSABILIDADE CIVIL DOS CIRURGIÕES PLÁSTICOS EM PROCEDIMENTOS ESTÉTICOS EMBELEZADORES | Author : Henrique Guaitolini, Alfredo Lampier Junior | Abstract | Full Text | Abstract :Concerning the topic of medical civil liability, the specific focus is on addressing the responsibility applicable to plastic surgeons engaged in exclusively aesthetic procedures. This area remains a source of uncertainty for legal practitioners, leading to divergent opinions. The objective is to provide a historical and conceptual overview, guiding the reader toward an understanding of the central theme, which revolves around the application of a doctors civil liability-either subjective with presumed guilt or objective-and its associated consequences. This study takes the form of a bibliographical and jurisprudential research, conducted through an integrative review. The goal is to examine the perspectives of leading legal scholars, the positions taken by higher courts, and an analysis of how the Brazilian legal system addresses this issue. Both the prevailing doctrine and judicial decisions commonly assert that the plastic surgeons obligation in aesthetic procedures is outcome-oriented, potentially involving either objective or subjective civil liability with a presumption of guilt. Upon careful consideration of the literature and legal sources, it becomes evident thatthe liability cannot be purely objective. This stems from the absence of legal provisions and/or the classification as a risky activity. The Civil Code of 2002 and the Consumer Defense Code clearly indicate the application of subjective responsibility. However, there is a notable confusion among scholars regarding these concepts and their applicability, with courts differing in their interpretation of the typicality of responsibility. These inconsistencies may pose formidable challenges for doctors involved in such disputes. |
| CHARACTERIZATION OF CUTANEOUS MELANOMA (CM): a narrative review | Author : Lairane Bridi Loss; Juliana Casotti Santi; Sarah A. Fernandes Lima; Mariana Santos Lorencini; Sabrina Chaves Costa Ferri; Rogério Pimentel Terra-Junior; Letícia Chiepe; Luiza Daleprani Stanger; Kelly Cristina Mota Braga Chiepe; Orlando Chiarelli-Neto | Abstract | Full Text | Abstract :Melanoma is the most aggressive type of skin cancer due to its metastatic potential, and its incidence has increased considerably in recent decades. Sun exposure to ultraviolet A and B cause DNA damage, mutations and induction of the melanomas. The focus here is an updated review on melanoma. Through early diagnostic detection of the malignant lesion, it is possible to initiate therapy in an early and curative way, increasing survival with a subsequent decrease in the overall mortality rate. Surgeries are the first treatment option, but chemotherapy/radiotherapyhave been alternative treatments for melanomas. Advances in immunotherapy and targeted therapy have changed treatment paradigms and improved the prognosis of late-stage disease. |
