The Problematic Relationship between Intellectuals and Social Classes |
Author : D.Haifaa Rasheed Hasan |
Abstract | Full Text |
Abstract :What can be deduced from the above is that the concept of the intellectual needs to be scrutinized so that the producers of cultural values ??have the n 5 opportunity of those who do not possess the scientific qualifications that can be exploited to claim the “culture” which can not be considered a culture because it does not contribute to the production of cultural values, . And that the concept of the class is misleading by all means so as not to prevail class feeling in fact, so that workers do not work out of that feeling to recognize the extent of the exercise of material and moral exploitation. And that the role of the class is related to the pattern of production, and the means of production and the conflict between classes, and the employment of science and technology in favor of the class struggle prevailing so that the employer is more useful than that conflict. And that the role of the intellectual is determined in the production of human values ??and class that unite the community on the one hand, and works to unite each social class separately on the other. And that the bias of the intellectual alongside the hard-working makes his culture of particular effectiveness that qualifies the hard workers to play an important role in human history. And that the relationship between the intersection and the difference between delinquency and class climbing between delinquency to the decline of the class in the intellectual figure is still present, and that the intellectual must decide in the bias to a certain class, and his reluctance between the desire to climb and the desire to commit suicide is a distinctive issue of the bourgeoisie The minority to which the intellectuals usually belong is excommunicated to absorb part of the surplus value in favor of the petty bourgeoisie. And that the confusion that affects the concept of the intellectual comes from the gems that affect the system of concepts that require reconsideration, to be based on the specificity that makes conceptual clarity prevail in economic, social, cultural, civil and political. In order to avoid the misinformation of various concepts, including the concept of the intellectual to the clarity of the cultural values ??that guide the individual and collective behaviors, and humanity and class in the framework of pluralism that serves the unity of humanity and the unity of the people, and the unity of the community, for societies in which the class struggle Which serves its development towards the best, in order to achieve noble human values ??in the direction of achieving freedom, democracy and social justice thanks to advanced and developed awareness that intellectuals are working to broadcast in human societies lacking such awareness. |

Author : Dr. Ahmed Samir Mohamed Yassin and Dr. Pan Isam Mohamed |
Abstract | Full Text |
Abstract :The integrity and justice of the judge is one of the important elements of the right to litigation, because the realization of the purpose of exercising this right, which is access to justice, is contingent upon the arbitrariness and impartiality of the judge. A tendency to one that earns the confidence of the litigants in it and their conviction to the judgments it issues. In order to achieve a fair and prompt and impartial justice, it is necessary to keep the judge away from the manifestations of arbitrariness in his use of the procedural right, which in turn makes his judgment biased against one of the opponents against the other without regard for the application of the right and the administration of justice. Here, in our study, we will deal with the theory of arbitrariness in the use of the right in the substantive law and the feasibility of its application in the Code of Civil Procedure. Justice will be contingent on the definition of the judges’ work and the elements of the abuse of the procedural right issued by the judge and the criteria for such abuse. |
